How-To Video Contest ("Contest")

PARTICIPATION IS VOLUNTARY.

HomeServe USA ("HomeServe" or "Sponsor") is the Sponsor of this Contest. HomeServe invites eligible partners to enter the How-To Video Contest ("Contest"), which is designed to recognize outstanding step-by-step instructional video content. We're asking Contractors, Technicians and Partners within our network to contribute to our video endeavours by sharing How-to or instructional content before, during or after a repair. The audience of this content will be everyday consumers who are looking to learn more about how to service their home and/or when to call in the pros. Share your name, the service you are providing and be clear and concise. Once the content is created, it must be shared with us via the provided QR code link ("Entry").

Eligibility: The How-To Video Contest is sponsored by HomeServe USA Corporation and is open only to HomeServe Technicians, Contractors and Partners that are legal residents of the United States or Canada, excluding Quebec, within the HomeServe network ("Eligible Entrant" or "Entrant"). HomeServe corporate employees are not eligible to participate in the Contest. The Contest is void outside the United States and where prohibited by law.
Voluntary Participation: No HomeServe Technicians, Contractors and Partners are required to participate in this Contest. All participation in this Contest is voluntary. Should you elect to participate in this Contest, all such participation must be done during your regular work hours.
Entry Period: The Contest begins on November 1, 2021 at 12:00 P.M. Eastern Standard Time ("EST") and ends on April 30, 2022 at 11:59 EST (the "Contest Period"). Within the Contest period, there will be 6 entry periods, one per month (each an "Entry Period"), scheduled as follows:

Entrant: Each Eligible Entrant who submits an Entry (defined below) in accordance with these Official Rules will be deemed an "Entrant."
How to Enter: During the Entry Period, submit a "How-to" or instructional video with content regarding real home repairs ("Entry"). Complete your Entry by uploading your video content using the QR code sent to you via email, sticker, or available at the top of this Official Rules document/ page. Your Entry must be in video format and include information or instructions before, during, or after a home repair. The audience of this content will be everyday consumers who are looking to learn more about how to service their home and/or when to call in the professionals. Valid entries will include your legal name, and a clear and concise description of the service you are providing. Sponsor reserves the right to disqualify at any time, any Entry that Sponsor determines in its sole discretion, does not meet the requirements of these Official Rules. Entries become sole property of Sponsor.
Submission Requirements: Entries must meet all of the following requirements, as determined by Sponsor in its sole discretion, or an entry may be disqualified:

Entries must be in the form of a video that includes content on "how to" or instructions before, during or after a home repair, directed towards everyday consumers who are interested in learning more about servicing their home or when to call in a professional.
Your Entry must comply with HomeServe's policies, including without limitation, the Code of Business Conduct and the Employee Handbook (collectively "HomeServe's Policies.")
Entries that depict, identify or include another person must have that person's consent to include him/her/them in the content, or parental consent for anyone under the age of 18.
Entrants may not submit content created or photographed by another third party, all content must be original and created, video taken by the entrant.
Content in the Entries may not violate any third party's copyrights or trademark rights and the Entry content should not depict any individuals that have not granted express permission to be featured. By submitting an Entry, you, the Entrant, represent and warrant that you have all necessary rights and permissions to submit and post the Entry content.
Entrants shall not submit content that is unlawful, defamatory, obscene, infringes of the intellectual property, privacy or publicity rights of other, is offensive, harassing or has the purpose or effect of creating an intimidating or hostile environment, uses obscenity, personal insults or other offensive language, in any way promotes unsafe activities that could lead to an unsafe situation involving the company's consumers or other individuals.
Entries shall not contain harmful content such as malware, viruses, time bombs, and other computer programming routines that could damage or interfere with a system, program, data, or personal information.

Judging/Winner Selection: Three members of the Sponsor's Content team ("Judges") will choose the best Entry received in the given monthly Entry Period. The criteria for choosing the winning entry includes content originality, camera orientation where widescreen footage is preferred, audio quality, video quality, sufficient length to demonstrate the job, detailed description of service/s being performed ("Criteria") The Judges will use the Criteria to evaluate and choose a winner for each Entry Period, in their absolute discretion ("Winner"). If the Judges do not receive any Entries, or do not receive Entries meeting the criteria for judging, the Prize may be forfeited for that monthly entry Period, in the Judges sole discretion. The Entry Period Winner will be chosen 3-5 business days after the conclusion of the given Entry Period. The odds of winning depend on the number of Entries received.
Prize/Approximate Retail Value: Six (6) Winners, one for each Entry Period, will each receive a Grand prize of an e-gift card valued at $500 ("Prize").
Bound by Rules: By participating in the Contest, you represent that you have read these Official Rules, understand and agree to be bound by these Official Rules, and that all decisions of Sponsor regarding the Contest are final and binding.
Winner Notification: Winner will be notified within approximately ninety (90) days of the end of the Entry Period. The Prize will be provided to the winner(s) via the email that the Entrant provided during the submission of the video.
Sponsor License to Use Entries: By submitting an Entry, Entrant grants Sponsor the irrevocable, perpetual, worldwide, sublicensable, absolute right and permission to use, publish, post, modify or display video content, name, likeness and photograph, voice, prize information, biographical information, any quotes attributable to an Entrant for advertising, trade, promotional, publicity purposes without any obligation or compensation of any kind to him or her anywhere worldwide. Entrant specifically waives any moral rights he/she/they have in the Entry content. Entrant agrees that Sponsor and its designees may exploit, edit, modify and distribute the Entry and all elements of such Entry in any and all media now known or hereafter devised, worldwide, in perpetuity without additional compensation, or notification to Entrant or any third party.
Disclaimer of Responsibility: HomeServe is not responsible for lost, late or misdirected entries or for entries which are not received for any reason. HomeServe is also not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, computer equipment, software, failure of any e-mail or entry to be received by HomeServe on account of technical problems, human error or traffic congestion on the intranet or Internet or at any web site, or any combination thereof. Persons who tamper with or abuse any aspect of the Contest or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified. Sponsor reserves the right to suspend, modify or terminate the Contest should any portion of the Contest appear corrupt or unfair or for any reason as determined by Sponsor in its sole discretion. If terminated, Sponsor will select the potential winner via the judging criteria set forth above from among all eligible, non-suspect Entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor.
LIMITATION OF LIABILITY: IN NO EVENT WILL HOMESERVE, OR ITS AFFILIATES, SUBSIDIARIES AND RELATED COMPANIES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, OTHER EMPLOYEES, REPRESENTATIVES AND AGENTS, BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF ENTRANT'S PARTICIPATION IN THIS CONTEST OR, IF CHOSEN AS A WINNER, THE ACCEPTANCE, USE OR INJURY FROM ANY PRIZE AWARDED, ACCEPTED OR USED. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU IF YOU LEGALLY RESIDE IN SUCH A JURISDICTION.
Winners List: At the conclusion of the Entry Period, Entrants may obtain a copy of the Winners List by requesting one from Eric Rossi at eric.rossi@homeserveusa.com.
